These Terms of Use (“Terms”) govern your access to and use of tresaguas.mx (the “Site”), operated by Sueno en Ecologico, S.A. de C.V. (“Tres Aguas,” “we,” or “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site. How we handle your personal data is explained in our Privacy Policy. The Spanish version (Términos y Condiciones) is the official one; this English version is provided for convenience, and if the two differ, the Spanish version prevails.
1. Who we are
Sueno en Ecologico, S.A. de C.V., with registered address at Calle 3A Norte, S/N, entre Calle 2A Poniente y Calle 3A Poniente, Col. Puerto Escondido Centro, C.P. 71980, Puerto Escondido, San Pedro Mixtepec, Juquila, Oaxaca, México. We do not operate a public sales office, and meetings are by appointment only. You can reach us at colby@tresaguas.mx, or by phone or WhatsApp at +52 954 139 9339.
2. What this Site is, and what it is not
The Site provides general information about the Tres Aguas development near Puerto Escondido, Oaxaca. It is not an offer, a solicitation, a reservation, or a contract of sale. No purchase exists, and neither you nor we are bound to buy or sell a lot, until a written purchase agreement has been signed by both parties and, where the law requires it, formalized before a Mexican notary.
3. Lots, prices, and availability
- Prices on the Site are shown in Mexican pesos (MXN) per square meter and may change without notice. Any USD or CAD amounts are indicative conversions only.
- The availability status shown on the masterplan or elsewhere (available, pending, sold) can change at any time and is not a reservation or a promise that a lot is still available.
- Lot categories (such as Gold Plus, Gold, Silver, Bronze, Commercial, and Hotel), positions, areas, dimensions, and boundaries are indicative until confirmed in the purchase documents. Please ask us for current, written information before you make a decision.
4. Renderings, maps, and planned features
Renderings, drone images, maps, and masterplan graphics are illustrative and conceptual, and the developer may change them at any time. Infrastructure, amenities, and features described as planned or under discussion, such as a beach club or sports courts, are not guaranteed to be built, to be built as described, or to be built on any particular schedule. Distances and travel times are approximate. Public works and third-party developments, such as airport expansions, highways, flight routes, and neighboring projects, are outside our control, and descriptions of them reflect information available when we wrote them.
5. No advice and no guarantees
Content on the Site, including statements about price growth, rental income, market trends, climate, hurricane risk, safety, flights, and ownership structures, is general information and opinion. Some of it is based on third-party sources that we do not control and cannot guarantee. It is not investment, legal, tax, or financial advice. Past performance and forecasts are not guarantees of future results, and the value of real estate can go down as well as up.
Please do your own research and take independent advice from a qualified lawyer, notary, and tax advisor before you buy. This matters especially for how a foreign buyer holds title to land in Mexico’s restricted coastal zone, and for title research and title insurance.
6. Using the Site
You agree to use the Site only for lawful purposes and not to:
- copy the Site’s content or data by automated means (scraping), or use bots to interact with it, without our written permission;
- interfere with the Site’s operation, security, or other visitors’ use of it, or introduce malicious code;
- try to access non-public or administrative areas, or other people’s data;
- submit false, misleading, or someone else’s information through our forms, or impersonate another person.
7. Inquiries and communications
When you contact us through a form, email, phone, or WhatsApp, you confirm that the information you give is accurate and that you are at least 18 years old. Contacting us does not create any obligation for you or for us. We may reply to you as described in our Privacy Policy.
8. Intellectual property
The Site’s text, photographs, drone footage, renderings, masterplan, logos, and the name “Tres Aguas” belong to us or our licensors and are protected by intellectual property laws. You may view the Site and print pages for your own personal, non-commercial use. You may not copy, republish, distribute, modify, or use the content commercially without our prior written permission. Linking to the Site is welcome.
9. Third-party services and links
The Site may link to or load services provided by others, such as Google, WhatsApp, Web3Forms, and Airtable. We do not control those services and are not responsible for their content, availability, or privacy practices. Your use of them is subject to their own terms.
10. Availability of the Site
We provide the Site “as is” and “as available.” We may change, suspend, or discontinue any part of it at any time, and we do not promise that it will always be available, error-free, or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by law, we disclaim all warranties about the Site and its content, and we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost opportunities, arising from your use of, or reliance on, the Site. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or willful misconduct. Any purchase of a lot is governed solely by the written purchase agreement signed for it, not by the content of the Site.
12. Changes to these Terms
We may update these Terms from time to time. The current version is always on this page with its date of last update. If you keep using the Site after a change, you accept the updated Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For any dispute about their interpretation or enforcement, you and we submit to the competent courts of the State of Oaxaca, Mexico, and waive any other venue that might apply because of present or future domicile or any other reason. This does not affect any rights you have under mandatory laws that cannot be waived.
14. General
If any part of these Terms is found to be unenforceable, the rest remains in effect. Our not enforcing a provision at any time is not a waiver of it. These Terms, together with the Privacy Policy, are the whole understanding between you and us about your use of the Site.
